Similar to prenuptial agreements, postnuptial agreements provide married couples with a safety net to protect their individual interests in the event of a divorce. I often recommend that my clients develop a postnuptial agreement if there is the slightest indication the marriage has become unstable or if one party starts hinting that it might be a good idea to enter into a trial separation or any other arrangement of that nature. A postnuptial agreement is particularly important if one of the marriage partners relocates to another city to take a new job or for any other reason and extends no offer to the other partner to come along.

A postnuptial agreement is designed to define the property interests of both partners in the marriage at a time when the lines of communication are still open. If the breadwinner is relocating to another city for a new job, the postnuptial agreement can be used to define the amount of family income which will be available to the partner not asked to relocate. This type of proactive agreement can prove invaluable in protecting the potentially spurned spouse and any children left behind. Frequently, the spouse who is hinting that the marriage is in trouble will enter into a postnuptial agreement to calm the waters while he or she assesses the worth of the marriage.
